The position of Senior Conduct and Regulatory Compliance Officer covers, as a main area of focus, the compliance regulatory risks of the market conduct area, with a specific focus on best execution and market abuse. In addition, this position will also cover the oversight of risks concerning activities of the Global Markets & Treasury Department, including the Desks of Treasury, Securities Lending & Collateral Management, Direct Access Services for professional clients and the Trading room, which supports EFG foreign affiliates in the execution of their trading business via the Swiss platform.

The position is based in Geneva, Zurich, or Lugano and within the Swiss Conduct and Regulatory Compliance Team of 4 people (2 colleagues in Geneva and 1 in Lugano). This team is in charge of overseeing the appropriate identification, management and mitigation of risks in the Conduct and Regulatory Compliance area such as cross-border risk, duties to Clients and investor protection (FinSA/FMIA, MiFID etc.), conflict of interests, oversight of relationship with External Asset Manager and Business Introducers, and Market Conduct.

Responsibilities include, but are not limited to, the following:

  • Ensure a robust compliance coverage over the risk of market abuse (insider trading and market manipulation), as well as best execution, to ensure that the Bank maintains at all times a robust control environment. For this purpose, the role holder will be expected to conduct thorough analysis of automated surveillance alerts through Market Surveillance IT systems such as BTCA, execute an enhanced surveillance of potentially suspicious clients and/or employees trading activity and maintain appropriate documentation for audit trail, and liaise with Financial Crime Unit in case of potential regulatory breach or criminal activity for appropriate action. With respect to best execution, the role holder will be expected to maintain an active oversight over best execution processes and monitoring, examining critically control results, and providing appropriate guidance and challenge to the first line of defence on the design and operating effectiveness of the control framework.
  • Identify and escalate any potential concerns or risks relating to - but not limited to - regulatory rules and bank policies. Prepare and provide required inputs diligently for the yearly compliance risk assessment as well as the regulatory and audit assessment (e.g. as per Finma circular 13/08, Finma questionnaire). Contribute to the production of reporting for the EFG Compliance committee and governance.
  • Provide compliance expertise in the drafting of the EFG Compliance policies and procedures under the team’s activities perimeter.
  • Be actively involved in enhancing current surveillance controls and developing new surveillance tools functionalities, reports and procedures; coordinate these actions with the Business; build professional relationships with external tool providers or execution venues.
  • Manage multiple critical tasks in a fast-paced environment e.g. maintenance of the Bank’s insider traders and overview of the watch and restricted List, coordinate the training for market abuse, answer compliance queries.
  • Identify, monitor regulatory changes in securities regulations and contribute in strategic Bank projects for the implementation and/or update of applicable policies and procedures (e.g. cross-booking account relationships). Raise awareness to EFG staff, on compliance risk by communicating these regulatory changes and news, coordinating delivering of compliance training, actively encouraging a culture of compliance.
  • Liaise and work as required with the key stakeholders (Global Markets and Treasury, Group Compliance, Risk functions, IT Department, etc.) to deliver Bank projects against defined timelines, operating under set procedures but demonstrating initiative and proactivity in making suggestions for improvement and greater efficiencies.
  • Cooperate and support Group Compliance in the performance of its consolidated supervision; specifically in the supervision of the EFG Affiliates abroad that channel their trading activities through the Swiss trading room. Liaise regularly with other Compliance teams abroad to ensure a consistent approach in the Group and an understanding of the regulatory and risk environment and their impact to processes and decision-making (e.g. MiFID II, EMIR, SFTR).
  • Provide advice and guidance on regulatory and compliance requirements, supporting– whenever needed - Senior Management of Compliance and the Global Markets & Treasury Department on matters related to trading regulations, in scoping, managing and delivering risk assessment.

Skills and experience

  • The Candidate should ideally have at least 8-10+ years of previous relevant experience and with exposure to Senior Management.
  • Strong product knowledge (equities, fixed income, options, structured products, etc.) and proven understanding of market conduct and trading / brokerage regulations (e.g. Financial Market Infrastructure Act, Market Abuse, MiFID II, EMIR / MiFIR), and ability to demonstrate strong knowledge of industry best practices and to maintain this knowledge accurate and relevant.
  • Relevant educational background in an area related to Trading, Finance, Law, Risk Management or similar professional certification.
  • Ability to develop risk assessment methodology, control framework, and policies and procedures for market abuse and best execution
  • Confidence to challenge the status quo, to demonstrate strong risk awareness, excellent judgment and decision-making skills.
  • Self driven, excellent organizational skills with the ability to prioritize multiple tasks, projects and assignments using effective time management skills.
  • Strong analytical skills, with proven ability to solve problems, and to provide high quality in requested tight time frame; possess a sense of urgency.
  • Active interaction with first line of defence at all levels, taking ownership of regulatory day-to-day tasks and projects on behalf of the team.
  • Excellent written and spoken skills in English; German, Italian, French would be a strong plus.
  • PC skills (MS Excel, Word and Power Point), including experience in producing presentations/memos addressed to Senior Management.
